Eligibility requirements

To be eligible to win the “Critique a Firefighter’s Book and Win Her Lake House” contest
(“Contest”), you must be at least 18 years old as of the date of entry;  purchase
“Firefighterette Gillette A Firefighter Who Crashed and Burned A Success Story” from:
www.firefighterettegillette.com or www.alacheripublishing.com; read it; return your
completed 500 word or less critique and information form, and comply with these Official
Rules. The Contest is open to all individuals world-wide, but is null and void where
prohibited by law. Officers, directors, employees and family members of Alacheri
Publishing, LLC, (“Sponsor”) and judges of the Contest and its affiliates, are not eligible
to enter. Winning a prize is contingent upon fulfilling all requirements set forth in the
rules. Sponsor reserves the right to disqualify any individual who has or is suspected to
have: (1) violated these Official Rules; (2) interfered with or attempted in any way to
manipulate the Contest or Contest results; (3) violated any law or regulation by
participating in the Contest; or (4) provided false information to Sponsor.
By entering Contest, entrants consent to be bound by these Official Rules, which shall
constitute a contract between entrants and Sponsor. All decisions of Sponsor with
respect to the Contest shall be final.

Timing

The Contest shall begin March 1st, 2009, 12:00 P.M. Daylight Savings Time and shall
continue until October 30th, 2009, 12:00 P.M. Daylight Savings Time (“Contest Period”),
unless extended or shortened by Sponsor in accordance with these rules. All critiques
must be postmarked on or before October 30th, 2009, and received no later than
November 6th, 2009. Entries received after the Contest Period will not be considered. If
less than 20,000 books are sold, a specific number of prizes that total a dollar amount
equal to the number of books times $10.00 will be awarded.  

How to enter to win your choice of the firefighter’s house or the money

Eligible individuals may enter the Contest by submitting a qualified entry to Sponsor
during the Contest Period. Entries must be received during the Contest Period. An
individual may enter as many times as he or she desires so long as each entry satisfies
the entry requirements. To qualify for entry into the Contest all entries must include the
following:

(1) Read “Firefighterette Gillette”. You may order it on-line. Click on BUY NOW. The cost
to order the book is $26.95 plus $8.00 U.S. for shipping, handling, and taxes for a total
cost of $34.95. If you live outside of the USA, you must add $5.00 additional for shipping
for a total of $39.95 U.S. After you order you can pay for your book with credit card. We
will ship your book and a two part form which is an official entry on special watermarked
paper with a tracking number on which you will print or write your critique consisting of
up to 500 words maximum and a form to fill out which will require all of your personal
information. The form and critique will have matching tracking numbers.     
(2) You can print your name, address and telephone number, and send an order for the
book and entry by sending a Personal Check, Money Order or Cashiers Check made
payable to: Alacheri Publishing 8335 Catamaran Dr, Indianapolis, In 46236. DO NOT
SEND CASH. All submissions that are paid with personal checks and returned to the
Sponsor and are NSF or not honored by the bank for any reason will be automatically
disqualified from the Contest. Your book and entry forms will not be shipped until the
check clears the Sponsor’s bank.
The above stated ways are the only channels to obtain an entry. Entries obtained through
any other channels or that are tampered with, illegible, mutilated, reproduced, contain
printing or other errors indicative of counterfeiting, obtained where prohibited or not
obtained legitimately are null and void.

Control of contest entry fees

All Contest entry fees will be held in an account established specifically for the purpose
of this Contest, with oversight provided by legal counsel during the entire course of this
event. Sponsor is not responsible for any late, lost, misdirected, incomplete, illegible
mail, or destruction of entries due to circumstances beyond the control of Sponsor. If
you want confirmation of receipt of your entry, you must send it via certified mail which
does not require a signature. Mail which requires a signature may not be accepted which
will be up to the discretion of the Sponsor.

Judges for the contest

There will be three independent judges evaluating the critiques based on originality,
sincerity and quality. The names of the judges will not be revealed. No judges are related
in any way to the author or Sponsor. This is a contest of skill and no gambling is
involved. The number of entries depends on the number of books purchased and the
number of critiques returned to be judged. The critiques will be separated from the
personal information forms. The critiques will be given to the judges and the information
forms will be kept by Alacheri Publishing, LLC. Judges will not know the identity of
entrants when judging the critiques. Therefore, it is imperative that you do not include
personal information that would identify you in your critique. Critiques containing
personal information will be disqualified. The decisions of the judges are final.
After the 25 winners are chosen by the judges, we will match the control numbers and
display the names of the winners with their critiques of the books on the home page of
the web sites.

Prizes and verification of potential winners  
                                                                               
There will be 25 winners chosen from the qualified entries received during the Contest
Period who will be awarded one of a potential twenty-five prizes. All potential prize
winners are subject to eligibility verification by the Sponsor. An entrant is not a winner of
any prize unless and until the entrant’s eligibility has been verified and the verification
process is complete. If sponsor so elects, a potential prize winner may be required to
submit to, and cooperate in, a confidential background check to confirm eligibility and to
ensure that the use of any such person in advertising or publicity for the Contest will not
bring Sponsor into any unfavorable situations and the above will be determined by
Sponsor at its sole discretion. No interest will be paid on any prizes.

Grand prize:

The grand prize for first place is a fee-simple title to the home located at:
14809 Latitude Way, Fortville, IN 46204,
and described in the legal description in the existing title. The approximate value of this
residence is $289,000.00.
An alternate prize of $100,000.00 may be requested and awarded. The house will be
granted free from any mortgage with property taxes paid up to date at time of closing.
Title insurance will be included in closing costs through the title company. All normal
closing costs will be covered by the Sponsor of this Contest, which include and are
limited to attorney fees, title company services for proper legal process and related
mailing fees for signatures related to the legal transfer of the property. The winner will
be responsible for their own transportation, hotel expenses, and any other incurred costs
related to attending the closing. The closing will be approximately one (1) month
following the end of the Contest Period. An exact closing date shall be set by the title
company. All federal, state, and local taxes are the sole responsibility of the Contest
winner. The residence is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND BY
SPONSOR OR ANY OTHER PERSON, expressed or implied, including, without limitation,
any implied warranty of merchantability or fitness for a particular purpose. Except where
prohibited by law, the winner must execute and provide to Sponsor the following: (1)
Affidavit of Eligibility, attesting to the winner’s eligibility and compliance with the
Official Rules; (2) a Liability Release, releasing Sponsor from any liability arising out of
the Contest; and (3) a Publicity Release, allowing Sponsor to use the winner’s name,
likeness, voice and biographical information for publicity purposes. Winner will also be
required to provide any other information needed by Sponsor to comply with applicable
laws and regulations, including those relating to the payment of income taxes. Winners
of prizes will receive a W-9 tax form to complete. By accepting a prize, winner grants
Sponsor permission for the use of his/her name, likeness and biographical information for
advertising and promotional purposes without additional compensation, except where
prohibited by law and the release form for this must be signed.

Runner up prizes:

Second prize: $10,000.00
Third prize: $5,000.00
Fourth prize: $1,000.00

The winners of 2nd, 3rd and 4th prizes will get their monetary awards in the form of a
check from Alacheri Publishing, LLC, approximately one (1) month following the end of
the contest period. An exact date shall be set by the sponsor. All federal, state, and local
taxes are the sole responsibility of the Contest winner. The winner will be responsible for
his or her own transportation and hotel expenses to attend a ceremony or the check can
be mailed upon request to the recipient. You do not have to be present to be awarded a
winning prize except for the closing of the house. Except where prohibited by law, the
winner must execute and provide to Sponsor the following: (1) Affidavit of Eligibility,
attesting to the winner’s eligibility and compliance with the Official Rules; (2) a Liability
Release, releasing Sponsor from any liability arising out of the Contest; and (3) a
Publicity Release, allowing Sponsor to use the winner’s name, likeness, voice and
biographical information for publicity purposes. Winner will also be required to provide
any other information needed by Sponsor to comply with applicable laws and regulations
including those relating to the payment of income taxes. Winners of prizes will receive a
W-9 tax form to complete. By accepting a prize, winner grants Sponsor permission for the
use of his/her name, likeness and biographical information for advertising and
promotional purposes without additional compensation, except where prohibited by law.

All of the above prizes are maximum awards and will be awarded only upon the sale of at
least 20,000 books. If 20,000 books are not sold, then a minimum dollar prize will be
awarded which will be equal to the number of books sold times ten dollars up to a
maximum of $100,000.00, cash and may constitute the only prize awarded. No money
will be refunded for any reason, even if the top prizes can not be awarded due to lack of
sales. For instance, if only ten books are sold, the one and only prize would be $100.00
cash.

5th through 25th prizes:

The 5th through 25th winners will be awarded an autographed copy of Engineer Gillette’s
next book which is planned to be “Molly Williams, Born a Slave, Freed a Firefighter”. It is
an account of Molly Williams who is purported to be the first female volunteer firefighter
in the United States. She was a slave in New York who won her freedom firefighting. She
is an inspiring figure who was admired by her fellow firefighters.

Prize Notification for 1st through 4th prizes                                              

The winners will be notified by phone or email, or in writing within ten (10) days of the
prize being awarded. If the Sponsor is unable to confirm the winner within ten (10)
business days of notification being sent, or if a winner is disqualified, then the prize will
be forfeited and awarded to the next runners up.
The display and color capabilities of your particular computer monitor, may affect the
colors of the grand prize actually seen on your screen. The Sponsor is not responsible for
the limitations of your monitor’s display of color, texture, or detail of the images of the
house. If documents or related graphics contain technical inaccuracies or typographical
errors, the Sponsor can not be held liable.

Prize notification for 5th through 25th prizes                                                             

The winners will be notified by phone or email, or in writing within ten (10) days of the
prize being announced. The firefighter’s next book will be sent upon its publication.
There is no publication date for her next book therefore the prize has no date for delivery.

No purchase necessary

Anyone may enter the contest by reading “Firefighterette Gillette” at the library or
borrowing the book from a friend. Send a self addressed stamped envelope to: Alacheri
Publishing, LLC, 8335 Catamaran Dr, Indianapolis, IN 46236, and a statement as to how
you were able to read the book. Include a request for an entry form for yourself. Only one
free request per household will be honored.

Copyright ownership and license

Entrant’s name, city, state, and all other information are non-confidential and the
Sponsor has the right, but not the obligation, to publish this information with
announcements, advertising and any other use the Sponsor feels is needed or wanted.
Entrants further agree that all submissions of entrants’ critiques become the property of
Sponsor and all title and interest shall belong to the Sponsor at the time of submission
and may be used by Sponsor for advertising and all other uses the Sponsor feels is
needed.

Governing law

Sponsor of the website and Contest is located in Indianapolis, IN, USA. The website can
be accessed from all 50 states, as well as from other countries around the world. Each of
these jurisdictions may have laws and regulations that differ from those of Indianapolis,
IN, USA. If you access this site, you must agree that the statutes and laws of
Indianapolis, IN, USA, will apply to the Contest and its official rules, and the entire
relationship between Sponsor and Entrants, and any legal proceedings which might arise
regardless of the grounds. If a dispute arises, you and Sponsor agree any litigation
between the parties shall be brought only in the state or federal courts having subject
matter jurisdiction in Indianapolis, IN, USA. You irrevocably and unconditionally consent
to the jurisdiction of any such court and waive any defense of an inconvenient forum or
proceeding and to any right of jurisdiction because of the place of residence or domicile
of any party thereto. You waive the right of collecting any and all attorney fees you may
be charged for any actions taken related to Contest or Sponsor. Any and all legal or other
actions arising from the Contest or taken against the Sponsor must be settled via
arbitration in Indianapolis, IN, USA.

Limitations of liability

In no event will Sponsor, its respective officers, directors, employees, representatives or
agents, immediate family, members or residents of their households, or judges of the
Contest, its affiliates or their employees and partners, the Sponsor’s web designer or
their respective officers, directors, employees, representatives or agents, immediate
family members or residents of their households, or any other individuals associated with
this contest be responsible or liable for any damages or losses of any kind, including
direct, indirect, incidental, consequential, statutory or punitive. Without limiting the
foregoing, with respect to the Contest and to the Prizes, Sponsor makes no warranty of
any kind, either express or implied, including but not limited to, the implied warranties or
merchantability of fitness for a particular purpose. Some jurisdictions may not allow the
limitations or exclusion of liability for incidental or consequential damages or exclusion
of implied warranties, therefore, some of the above limitations or exclusions may not
apply to you. Check your local laws for any restrictions or limitations regarding these
limitations or exclusions.

Amendment of rules

Sponsor may amend the Official Rules at its sole discretion. Amendments will be posted
on the Sponsor Website. Unless otherwise specified, any amendments will become
effective on the day they are posted on this Site.

Entire agreement

This Agreement including exhibits, (if any) contains all agreements between the Parties
and is void where prohibited by law. There are no other representations, warranties,
promises, agreements or understandings, oral, written, or implied, among the Parties,
except to the extent that reference is made thereto in this Agreement.

Name removal notification

Parties wishing to have their name removed from Sponsor’s mailing list should send
requests to: Alacheri Name Removal, 8335 Catamaran Dr, Indianapolis, IN 46236. Your
name will be removed within 60 days.
